By accessing or using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

3. Use of services

Our apps and courses are designed for education, creativity, and skill development. You agree to use them responsibly and lawfully.

• You must be at least 18 years old or have parental consent to use our services.
• You are responsible for maintaining the security of your account and login credentials.
• You agree not to misuse our AI systems or generate harmful content.
• You may not share, resell, or redistribute course content or your account access.

4. Online courses (TK100X Academy)

4.1 Scope of service

TK100X Academy offers self-paced online courses delivered as digital content via academy.tk100x.com. Upon purchase, you receive lifetime access to the course materials available at the time of purchase. Course content may be updated or expanded at our discretion.

4.2 Purchase and payment

Course purchases are processed via Stripe. The price displayed at the time of checkout is binding. All prices include VAT where applicable. Payment is due immediately upon purchase. You will receive an email confirmation with your login credentials after successful payment.

4.3 Access and delivery

After successful payment, you will receive an email with a one-time login code. Course content is delivered digitally and accessible immediately through your browser. No physical goods are shipped.

4.4 License

Your purchase grants you a personal, non-transferable, non-exclusive license to access and use the course content for your own educational purposes. You may not copy, reproduce, distribute, publicly display, or create derivative works from the course materials without our written consent.

5. Right of withdrawal (Widerrufsrecht)

5.1 30-day money-back guarantee

We offer a 30-day money-back guarantee on all course purchases. If you are not satisfied with the course for any reason, you may request a full refund within 30 days of your purchase date by contacting us at [email protected].

5.2 EU right of withdrawal

Under EU consumer protection law, you have the right to withdraw from a distance contract within 14 days without giving any reason. The withdrawal period begins on the day of purchase. Our 30-day money-back guarantee extends this statutory period.

To exercise your right of withdrawal, you must inform us (TK100X GmbH, [email protected]) of your decision to withdraw by means of a clear statement (e.g. an email). Upon receipt of a valid withdrawal request, we will process your refund within 14 days using the same payment method used for the original purchase.

5.3 Refund process

Refunds are processed via Stripe to the original payment method. Processing may take 5–10 business days depending on your bank or card issuer. Upon refund, your access to the course will be revoked.

6. App subscriptions and payments

Some of our apps offer premium subscriptions. These are managed via the Apple App Store or Google Play Store. Cancellations and refunds for app subscriptions are subject to the respective store's policies.

7. Intellectual property

All content, design, course materials, and technology within our apps and courses are owned by TK100X GmbH or its licensors. Your user-generated content remains yours, but you grant us a non-exclusive license to use it to provide and improve our services.

8. Disclaimers and liability

Our services are provided "as is" without warranties of any kind, except as required by mandatory consumer protection laws. Course content is for educational purposes and does not constitute professional advice.

To the maximum extent permitted by Austrian law, TK100X GmbH shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. This limitation does not apply to damages caused by intent or gross negligence, or to liability that cannot be excluded under mandatory law.

9. Data protection

We process your personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). By purchasing a course, you consent to receiving transactional emails related to your purchase and account access.

10. Governing law and dispute resolution

These terms are governed by the laws of Austria. For consumers residing in the EU, mandatory consumer protection provisions of your country of residence apply in addition.

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Any disputes shall be resolved in the competent courts of Graz, Austria, subject to mandatory jurisdiction rules for consumers.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
